The new property assessment rolls for the agglomeration of Montréal

January 2011

January 1, 2011 marked the coming into force of the new property assessment rolls for the 16 municipalities forming the agglomeration of Montreal. These rolls will be used as a basis for levying municipal and school taxes for at least the next three years. That value can only be contested during the first year of the roll, before May 1st. After that time, the owner will have to live with the value assigned to his property for at least three years, until the next rolls are deposited.

How to claim your attorneys’ fees from a delinquent payer

The age of bartering is past. Today, most contracts are for financial consideration and include a payment in money.  Such payment may consist of consideration for a sale, remuneration for a service, reimbursement of a loan and the interest due on it or the rent stipulated in a lease. By necessity, the amount of the payment inevitably includes some profit or benefit for the creditor. This process exemplifies the fragile equilibrium of free market forces such as competition or supply and demand, drawn up on paper in legal terms.

Les cautionnements de contrats de construction

Le client peut résilier le contrat unilatéralement, quoique la réalisation de l'ouvrage ou la prestation du service ait déjà été entreprise. Ce droit à la résiliation n'a pas à être motivé. Il est lié à la nature même du contrat d'entreprise ou de service qui repose sur les attentes particulières du client. Évidemment, le client est tenu de dédommager l'entrepreneur ou le prestataire de service pour les dommages causés par cette résiliation unilatérale, puisqu'il ne pourra pas obtenir l'exécution spécifique de l'obligation.

La nature et l'étendue du contrat d'entreprise ou de service

Le contrat d'entreprise ou de service est celui par lequel une personne, selon le cas, l'entrepreneur ou le prestataire de service, s'engage envers une autre personne, le client, à réaliser un ouvrage matériel ou intellectuel ou à fournir un service moyennement un prix que le client s'oblige à lui payer. L'entrepreneur est donc celui qui réalise un ouvrage alors que le prestataire de service est celui qui fournit un tel service.
